Terms of Use

These Terms of Use (“Terms”) govern the rights, obligations, and responsibilities between Fingerlabs Inc. (“Company”) and the Member, in relation to the use of content purchases and services (including web, mobile web, and applications) provided by Xclusive (“Service”).

These Terms apply to your use of the Xclusive service. The term “Xclusive service” or “our service” refers to all features and functions, recommended content and reviews, the Xclusive website and user interface, and any personalized services provided by Xclusive in connection with the search and use of Xclusive content. The term “you” refers to the Member who creates an Xclusive account and purchases or uses products within Xclusive.

1. Description and Definitions

The Company shall explain to the Member, prior to the first contract, the nature of the Service and key usage conditions separately from these Terms.

• Member: A person who agrees to the Xclusive Terms and creates an account, continuously accessing free or paid information provided by the Company.

• Content Purchaser: A Member who pays an additional fee to access content.

• Content: Data or information expressed in codes, characters, sounds, images, or videos used in the information and communications network, as defined in Article 2(1)(1) of the Act on Promotion of Information and Communications Network Utilization and Information Protection.

• Payment: The act of a Member paying a certain amount to the Company via various payment methods to use paid services.

2. Effectiveness and Changes to the Terms

These Terms shall apply from the date the Member agrees to them until the Member deletes the account.

The Company may revise these Terms as needed and shall post the previous and revised Terms along with the effective date at least 7 days in advance on the website. If the revision is unfavorable to Members, it will be announced 30 days in advance. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

3. Promotions

Xclusive may provide special promotions or promotional memberships (“Promotions”). Eligibility for Promotions is determined at the sole discretion of Xclusive, which may revoke Promotions or suspend access to content or accounts if eligibility criteria are not met.

Xclusive may use information such as device ID, name, birth date, and email to determine eligibility, subject to separate consent. Additional terms and restrictions will be disclosed at the time of promotion or through related communications.

4. Xclusive Service

4-1. Collection of Personal Information

Collected Items:

• Email

• Mobile phone number

• Name

• Date of birth

• Nationality

Purpose of Collection:

• For event application and winner selection

• For order confirmation during payment

• For sharing content and contact purposes

Personal data is retained for one year after account withdrawal and then destroyed.

4-2. Usage Scope

Xclusive content and services must be used for personal, non-commercial purposes only. Sharing accounts is prohibited.

Xclusive grants Members a limited, non-exclusive license to access content during its availability. No rights, ownership, or titles are transferred. Public performances are prohibited. Streaming is supported, but downloads are not.

4-3. Regional Restrictions

Content may only be accessed in regions licensed by Xclusive. Content availability varies by region and is subject to change.

4-4. Usage Restrictions

Members agree to comply with all relevant laws and not to:

1. Archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, or exploit content obtained through the service.

2. Bypass or alter copyright notices, trademarks, UI elements, or content protection features.

3. Use robots, spiders, scrapers, or any automated tools to access the service.

4. Reverse-engineer or disassemble any part of the service.

5. Insert code or interfere with content.

6. Use data mining, scraping, or similar methods.

7. Upload or transmit software viruses or malicious code.

Violations of Sections 4-1 through 4-3, or participation in fraud (e.g., piracy, identity theft, payment fraud, account sharing) may result in service termination or suspension.

4-5. Prohibited Speech

The Company may impose sanctions on hateful content, including:

• Discriminatory or conflict-inducing text

• Content harmful to minors

• Any other text that violates or resembles violations of applicable laws

4-6. Simultaneous Streaming

Restrictions may apply to simultaneous viewing from the same account.

5. Membership Termination and Disqualification

1. Members may request to terminate their account at any time, and the Company will promptly process the request.

2. Termination is completed within 10 business days. During this period, login is still possible, but new account creation is not.

3. All content and purchases will be deleted upon withdrawal.

4. Re-registration is allowed 30 days after the initial withdrawal.

5. Personal data is stored for one year after withdrawal and then destroyed.

6. Disclaimers and Limitations of Liability

Xclusive strives to provide reliable service but may experience interruptions without fault. The Company is liable only for damages caused by intent or gross negligence and not for special or indirect damages.

Third-party advertisements may appear in the Service. Xclusive does not endorse or sponsor such ads, and all interactions with advertisers are the Member's sole responsibility.

7. Miscellaneous

Xclusive offers exclusive content for a limited time through this platform. The exclusivity period is determined through agreements with production companies and may vary by title. Each exclusive period will be disclosed on the product detail page.
